These Platform Terms govern the use of www.artmstrs.com (“Platform”) operated by ARTMSTRS B.V., The Netherlands, Europe, Chamber of Commerce number 86550608.
These Terms apply to:

Specific Artist Terms and Buyer Terms apply in addition where relevant.
1. Role of ARTMSTRS
ARTMSTRS operates an online curated art marketplace.
ARTMSTRS facilitates:

Publication of artworks
-
Marketing activities
-
Order processing
-
Payment handling
-
Communication flow
ARTMSTRS acts as an intermediary between Artist and Buyer.
The sales contract is concluded between the Artist and the Buyer.
2. Platform Availability
We strive for continuous availability of the Platform.
However, we do not guarantee uninterrupted or error-free operation.
ARTMSTRS may temporarily suspend or modify the Platform for maintenance or improvements.
3. Intellectual Property
All intellectual property rights relating to the Platform, branding, design and structure remain the property of ARTMSTRS or its licensors.
Artists retain full copyright in their artworks.
4. Limitation of Liability
ARTMSTRS is liable only to the extent permitted under Dutch law.
We are not liable for:

Indirect or consequential damages

Loss of data
-
Business interruption
-
Artist sales performance
Liability, if applicable, is limited to the amount paid under the relevant User Agreement.
Nothing in these Terms limits liability where exclusion is not permitted by law.
5. Governing Law & Disputes
These Platform Terms and all related agreements are governed exclusively by Dutch law.
Disputes shall be submitted to the competent court in the Netherlands.
If the Buyer qualifies as a Consumer under EU law, mandatory consumer protection provisions of the Consumer’s country of residence may apply in addition to Dutch law.

If the Buyer qualifies as a Consumer within the meaning of European Union law, mandatory consumer protection provisions of the country of the Consumer’s habitual residence may apply, in addition to Dutch law.

Nothing in these Terms & Conditions shall limit or exclude any mandatory rights granted to Consumers under applicable European Union consumer protection legislation, including but not limited to the Consumer Rights Directive (2011/83/EU).

Consumers purchasing via the Platform generally have the right to withdraw from a Purchase Agreement within fourteen (14) days after receipt of the Product, unless a statutory exception applies (such as customized or made-to-order products).

Refunds following a valid withdrawal will be processed in accordance with applicable EU law and, where required, within fourteen (14) days after valid notice of withdrawal, subject to receipt of the returned Product or proof of return.

These Terms & Conditions remain governed by Dutch law. However, where mandatory consumer protection rules of the Consumer’s country of residence provide greater protection, those mandatory provisions shall prevail.

These Artist Terms apply to all Artists and Galleries offering artworks on the Platform.
They form part of the ARTMSTRS Platform Terms.
1. Registration & Approval
Artists must register and provide accurate and truthful information.
Approval occurs in two stages:

Individual artwork curation
ARTMSTRS reserves the right to reject submissions based on quality standards.
2. Pricing
Artists determine their own prices.
Prices must be accurate, transparent, and not misleading.
3. Commission
ARTMSTRS charges commission on sold artworks according to the chosen subscription plan.
Online payment fees are included in the commission.
4. Subscription & Duration
User Agreements may be entered into for:

Monthly

12, 24, 36, 48 or 60 months
Agreements renew automatically per month unless terminated in writing.
Paid subscription fees are non-refundable.
5. Orders & Delivery
When a Buyer places an order:

The Buyer pays ARTMSTRS

The Artist ships the artwork
-
The Artist must package securely and provide track & trace
The Artist is responsible for:

Correct delivery
-
Conformity of the artwork
-
Accurate descriptions
6. Withdrawal & Payout
Consumers may have a 14-day withdrawal right.
Payout to the Artist will be processed after:

Confirmation of delivery, and
-
Expiry of the withdrawal period
Payouts may be temporarily suspended if a complaint is pending.
7. Copyright & Usage Rights
Artists retain full copyright.
Artists grant ARTMSTRS a non-exclusive license to use low-resolution and high-resolution files for:

Promotion
-
Marketing
-
Advertising
-
Print production for sold editions
8. Prohibited Conduct
Artists may not:

Offer illegal goods
-
Offer stolen goods
-
Accept direct payments for Platform orders

Provide misleading information
9. Indemnification
Artists indemnify ARTMSTRS against claims arising from:

Infringement of third-party rights
-
Non-delivery
-
Misrepresentation
10. Governing Law
These Artist Terms are governed exclusively by Dutch law.
ARTMSTRS Buyer Terms & Conditions — 👉 Read Buyer Terms
These Buyer Terms apply to all purchases made via the Platform and form part of the Platform Terms.
1. Purchase Agreement
When placing an order via the Platform:

A binding agreement is concluded between the Buyer and the Artist.

ARTMSTRS processes payment on behalf of the Artist.
2. Payments
Payments are processed securely via trusted payment providers.
Buyers must complete payment through the Platform.
3. Shipping
Artists are responsible for shipping.
Shipping costs are displayed during checkout.
4. EU Consumer Rights
If the Buyer qualifies as a Consumer under EU law:

The Consumer has the right to withdraw within 14 days after receiving the artwork, unless a statutory exception applies (e.g. customized items).
Refunds will be processed within the legally required timeframe, typically within 14 days after valid withdrawal and receipt of the returned artwork.
Return shipping costs are borne by the Consumer unless otherwise required by law.
5. Complaints
Buyers must report complaints within a reasonable time.
ARTMSTRS will assist in resolving disputes between Buyer and Artist.
6. Authenticity
Artists guarantee authenticity of artworks offered.
Where applicable, artworks are signed and accompanied by a certificate of authenticity.
7. Governing Law
These Buyer Terms are governed exclusively by Dutch law.

6. Returns

At ARTMSTRS, we aim to provide a transparent and fair experience for collectors and artists. This policy explains how returns and refunds are handled.
1. EU Consumer Right of Withdrawal
If you qualify as a Consumer under European Union law, you generally have the right to withdraw from your purchase within fourteen (14) days after receiving the artwork.
You do not need to provide a reason.
To exercise your right of withdrawal, you must notify ARTMSTRS within the 14-day period by email at: [insert email].
2. Return Conditions
To qualify for a refund:

The artwork must be returned within 14 days after withdrawal.

The artwork must be in original condition.

All accessories and certificates must be included.

The artwork must be properly packaged for safe return.
The Consumer is responsible for return shipping costs unless otherwise required by law.
3. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

Commissioned artworks

Personalized or made-to-order prints

Limited editions produced on demand
These exceptions follow EU consumer legislation.
4. Refund Timeline
