These Platform Terms govern access to and use of www.artmstrs.com (the “Platform”), operated by ARTMSTRS B.V., The Netherlands, registered with the Dutch Chamber of Commerce under number 86550608.
These Terms apply to all users of the Platform, including:

Artists
-
Galleries
-
Buyers
-
Visitors
Where applicable, additional Artist Terms and Buyer Terms apply and shall prevail in case of conflict.
1. Nature of the Platform
ARTMSTRS operates as a curated international art gallery platform, presenting and promoting selected contemporary artists to collectors worldwide.
The Platform facilitates:

Professional presentation of artworks
-
Curatorial review and selection
-
Marketing and promotional activity
-
Order processing and secure payment handling
-
Communication between Artist and Buyer
-
Logistics coordination where applicable
ARTMSTRS acts as an intermediary in transactions conducted through the Platform.
The contract of sale for each artwork is concluded directly between the Artist and the Buyer.
2. Curatorial Position
ARTMSTRS maintains a curated structure.
Publication of artworks is subject to internal review and quality standards.
ARTMSTRS reserves the right to:

Approve or decline submissions

Remove artworks or accounts
-
Modify presentation format
Such decisions are made to preserve the integrity and positioning of the Platform.
3. Platform Availability
We strive to ensure professional and reliable access to the Platform.
However, ARTMSTRS does not guarantee uninterrupted, error-free or completely secure operation.
We reserve the right to suspend, restrict or modify the Platform temporarily for maintenance, security updates or strategic improvements.
4. Intellectual Property
All intellectual property rights relating to the Platform — including branding, visual identity, structure, design and proprietary systems — remain the exclusive property of ARTMSTRS or its licensors.
Artists retain full copyright and intellectual property rights in their artworks.
Nothing in these Terms transfers ownership of intellectual property unless explicitly stated.
5. Limitation of Liability
To the maximum extent permitted under Dutch law, ARTMSTRS shall not be liable for:

Indirect or consequential damages

Loss of profit, opportunity or reputation

Loss of data
-
Business interruption
-
Artist sales performance or expected results
Where liability arises, it shall be limited to the total amount paid by the relevant user under the applicable User Agreement during the twelve (12) months preceding the claim.
Nothing in these Terms excludes liability where exclusion is not permitted by applicable law.
6. Governing Law & Jurisdiction
These Platform Terms and all related agreements are governed exclusively by Dutch law.
Any disputes shall be submitted to the competent court in The Netherlands.
If a Buyer qualifies as a Consumer under applicable EU legislation, mandatory consumer protection provisions of the Consumer’s country of residence shall apply in addition to Dutch law.

If the Buyer qualifies as a Consumer within the meaning of European Union law, mandatory consumer protection provisions of the Consumer’s country of habitual residence shall apply in addition to Dutch law.

Nothing in these Terms shall limit or exclude any mandatory rights granted to Consumers under applicable EU consumer protection legislation, including Directive 2011/83/EU on Consumer Rights.

Consumers have the right to withdraw from a Purchase Agreement within fourteen (14) days from the day on which the Consumer, or a third party indicated by the Consumer (other than the carrier), acquires physical possession of the Product, unless a statutory exception applies.

To exercise the right of withdrawal, the Consumer must notify ARTMSTRS by an unequivocal statement (e.g., by email or by using the model withdrawal form, where provided) before the withdrawal period expires.

The Consumer shall bear the direct costs of returning the Product, unless otherwise agreed.

Refunds following a valid withdrawal shall be processed within fourteen (14) days after receipt of the withdrawal notice. ARTMSTRS may withhold reimbursement until the returned Product has been received or the Consumer has supplied evidence of having sent back the Product, whichever is earlier.

The right of withdrawal does not apply to:

Custom-made or clearly personalized products;
-
Made-to-order or limited edition prints produced upon request;
-
Digital content once performance has begun with the Consumer’s prior express consent and acknowledgment that the right of withdrawal is thereby lost.

These Terms remain governed by Dutch law. However, where mandatory consumer protection rules of the Consumer’s country of residence provide greater protection, those mandatory provisions shall prevail.

ARTMSTRS Artist Terms & Conditions — 👉 Read Artist Terms
These Artist Terms apply to all Artists and Galleries offering artworks on the Platform.
They form part of the ARTMSTRS Platform Terms.
1. Registration & Approval
Artists must register and provide accurate and truthful information.
Approval occurs in two stages:

Artist approval

Individual artwork curation
ARTMSTRS reserves the right to reject submissions based on quality standards.
2. Pricing
Artists determine their own prices.
Prices must be accurate, transparent, and not misleading.
3. Commission
ARTMSTRS charges commission on sold artworks according to the chosen subscription plan.
Online payment fees are included in the commission.
4. Subscription & Duration
User Agreements may be entered into for:

Monthly

12 months
Agreements renew automatically per month unless terminated in writing.
Paid subscription fees are non-refundable.
5. Orders & Fulfilment
When a Buyer places an order:

The Buyer pays ARTMSTRS.

ARTMSTRS coordinates fulfilment and logistics.
Originals (Unique Artworks)
For original artworks:
-
The Artist is responsible for securely packaging the artwork in accordance with ARTMSTRS shipping guidelines.

ARTMSTRS arranges insured shipping through a professional carrier.
-
All shipments are insured for the full sales value of the artwork unless otherwise agreed in writing.
-
ARTMSTRS provides track & trace information to the Buyer.
Risk of loss or damage remains with the seller in accordance with applicable consumer protection law and transfers to the Buyer only upon physical receipt of the artwork.
The Artist remains responsible for:

Conformity of the artwork;
-
Accuracy of descriptions;
-
Proper and professional packaging.
If damage occurs due to insufficient packaging by the Artist, ARTMSTRS reserves the right to recover costs from the Artist.
Insurance & Liability Limitation
All shipments arranged by ARTMSTRS are insured for the full sales value of the artwork, subject to the terms and conditions of the applicable carrier and insurance provider.
In the event of loss or damage during transport, ARTMSTRS shall assist in filing and handling the insurance claim.
However, ARTMSTRS shall not be liable for any amount exceeding the compensation actually paid by the carrier or insurer.
If the insurance provider refuses or partially refuses compensation due to circumstances beyond ARTMSTRS’s control — including but not limited to carrier limitations, force majeure, customs delays, or improper packaging by the Artist — ARTMSTRS shall not be liable for the uncovered portion of the loss, except where liability cannot be excluded under mandatory law.
Nothing in this clause limits mandatory consumer protection rights under applicable law.
Limited Editions & Prints
For limited editions and prints produced upon sale:

ARTMSTRS manages professional production through certified print partners.

ARTMSTRS handles packaging, certification (where applicable), and insured international fulfilment.

Shipments are insured for the full sales value.
-
ARTMSTRS provides track & trace information to the Buyer.
The Artist grants ARTMSTRS the right to produce, certify, and distribute the agreed edition.
US fulfilment applies to designated territories as described on the Platform.
6. Withdrawal & Payout
Consumers may have a 14-day withdrawal right.
Payout to the Artist will be processed after:

Confirmation of delivery, and
-
Expiry of the withdrawal period
Payouts may be temporarily suspended if a complaint is pending. ARTMSTRS may retain commission if a return results from Artist misrepresentation or non-conformity.
7. Copyright & Usage Rights
Artists retain full copyright.
Artists grant ARTMSTRS a non-exclusive license to use low-resolution and high-resolution files for:

Promotion

Marketing
-
Advertising
-
Print production for sold editions
8. Prohibited Conduct
Artists may not:

Offer illegal goods
-
Offer stolen goods
-
Accept direct payments for Platform orders

Provide misleading information
9. Indemnification
Artists indemnify ARTMSTRS against claims arising from:

Infringement of third-party rights
-
Non-delivery
-
Misrepresentation
10. Governing Law
These Artist Terms are governed exclusively by Dutch law.
ARTMSTRS Buyer Terms & Conditions — 👉 Read Buyer Terms
These Buyer Terms apply to all purchases made via the Platform and form part of the ARTMSTRS Platform Terms.
1. Purchase Agreement
When placing an order via the Platform:

A binding agreement is concluded between the Buyer and the Artist.

ARTMSTRS facilitates the transaction and processes payment on behalf of the Artist.
-
ARTMSTRS coordinates fulfilment and logistics.
2. Payments
Payments must be completed through the Platform.
All payments are processed securely via trusted and regulated payment providers.
ARTMSTRS does not store full payment card information.
3. Fulfilment & Shipping
ARTMSTRS coordinates insured shipping for all artworks.
Originals
For original artworks:

The Artist prepares and securely packages the artwork.
-
ARTMSTRS arranges insured transport via a professional carrier.
-
The shipment is insured for the full sales value.
Limited Editions & Prints
For prints and limited editions:
-
ARTMSTRS manages production through certified professional print partners.
-
ARTMSTRS handles packaging, certification (where applicable), and insured international fulfilment.
Track & trace information is provided to the Buyer where available.
Risk of loss or damage transfers to the Buyer only upon physical receipt of the artwork in accordance with applicable consumer protection law.
4. EU Consumer Rights
If the Buyer qualifies as a Consumer under European Union law:

The Consumer has the right to withdraw from the Purchase Agreement within fourteen (14) days from the day the Consumer (or a designated third party) receives physical possession of the artwork, unless a statutory exception applies.
Exceptions may include:

Custom-made artworks
-
Made-to-order prints
-
Clearly personalized works
-
Digital content once execution has begun with prior express consent

Prints produced according to the Buyer’s selected size and print medium are considered goods made to the Consumer’s specifications within the meaning of Article 16(c) of Directive 2011/83/EU and are therefore excluded from the right of withdrawal.
To exercise the right of withdrawal, the Consumer must notify ARTMSTRS by an unequivocal statement (e.g., email) before the withdrawal period expires.
Return shipping costs are borne by the Consumer unless mandatory law provides otherwise.
Refunds will be processed within fourteen (14) days after valid notice of withdrawal. ARTMSTRS may withhold reimbursement until the returned artwork has been received or proof of return has been provided.
5. Shipping Insurance & Liability
All shipments arranged by ARTMSTRS are insured for the full sales value, subject to the terms and limitations of the carrier and insurance provider.
In the event of loss or damage during transport, ARTMSTRS will assist in handling the insurance claim.
However:
ARTMSTRS shall not be liable for any amount exceeding the compensation actually paid by the carrier or insurer.
If the insurance provider refuses or partially refuses compensation due to circumstances beyond ARTMSTRS’s control — including carrier limitations, customs delays, force majeure, or improper packaging — ARTMSTRS shall not be liable for any uncovered portion of the loss, except where liability cannot be excluded under mandatory law.

6. Complaints & Disputes
Buyers must report visible damage or conformity issues within a reasonable time after discovery.
ARTMSTRS will assist in resolving disputes between Buyer and Artist in good faith.
7. Authenticity
Artists guarantee the authenticity of their artworks.
Where applicable:

Artworks are signed

Limited editions are numbered
-
A certificate of authenticity is provided
For prints and editions produced by ARTMSTRS, certification may be issued by ARTMSTRS in accordance with the agreed edition structure.

After confirmed delivery and expiration of the statutory withdrawal period (where applicable), payout is processed.
4. Payout Structure
Payouts are processed after:

Expiration of the applicable statutory withdrawal period
This ensures legal compliance and buyer confidence.
Commission depends on your selected subscription plan.
5. Shipping & Insurance
All shipments arranged by ARTMSTRS are insured for the full sales value, subject to carrier terms and insurance conditions.
In the event of transport damage or loss:

ARTMSTRS assists in handling the insurance claim.

Compensation is limited to the amount paid by the carrier or insurer.

ARTMSTRS is not liable for amounts exceeding the insurance payout, except where mandatory law provides otherwise.
If damage results from insufficient packaging by the Artist, ARTMSTRS reserves the right to recover related costs.
6. Your Responsibilities
As an Artist, you are responsible for:

7. Returns & Withdrawal

Returns & Refund Policy

At ARTMSTRS, we aim to provide a transparent, fair and legally compliant experience for both collectors and artists. This policy explains how returns, withdrawals and refunds are handled.
1. EU Consumer Right of Withdrawal
If you qualify as a Consumer under European Union law, you have the right to withdraw from your purchase within fourteen (14) days from the day you (or a third party designated by you, other than the carrier) acquire physical possession of the artwork.
You are not required to provide a reason.
To exercise your right of withdrawal, you must notify ARTMSTRS before the withdrawal period expires by sending an unequivocal statement by email to:

2. Return Procedure & Conditions
After notifying ARTMSTRS of withdrawal:

The artwork must be returned within fourteen (14) days from the date of the withdrawal notice.

The artwork must be returned in its original condition.

All certificates, accessories, documentation and original packaging must be included.
-
The artwork must be securely packaged to prevent transport damage.
The Consumer bears the direct cost of return shipping unless mandatory law provides otherwise.
Risk of loss or damage during return shipment remains with the Consumer until the artwork has been received by the designated return address.
3. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:

Custom-made or commissioned artworks;
-
Prints produced according to the Buyer’s selected size and print medium are considered goods made to the Consumer’s specifications within the meaning of Article 16(c) of Directive 2011/83/EU and are therefore excluded from the right of withdrawal.

Clearly personalized works;
-
Digital content once performance has begun with prior express consent.
These exclusions are based on Article 16(c) of Directive 2011/83/EU (goods made to the Consumer’s specifications).
By placing an order for such products, the Buyer expressly acknowledges that production begins upon confirmation and that the right of withdrawal does not apply.
4. Refund Timeline
Refunds will be processed in accordance with applicable EU consumer legislation and no later than fourteen (14) days after:

The withdrawal notice has been received, and
-
The returned artwork has been received by ARTMSTRS or the Artist, or
-
Proof of return has been provided (whichever occurs first).
ARTMSTRS may withhold reimbursement until one of the above conditions is met.
Refunds will be issued using the original payment method unless otherwise agreed.
5. Damaged, Defective or Incorrect Delivery
If an artwork arrives damaged, defective, or materially different from its description:

You must notify ARTMSTRS within a reasonable time after discovery.

Clear photographic evidence must be provided.

ARTMSTRS will coordinate with the Artist and the insured carrier where applicable.
Where damage occurred during insured transport arranged by ARTMSTRS, we will handle the insurance claim process.
Compensation is limited to the amount recoverable under the applicable insurance or carrier policy, except where mandatory law provides otherwise.
6. Insurance & Liability Limitation
All shipments arranged by ARTMSTRS are insured for the full sales value, subject to carrier and insurance terms.
ARTMSTRS is not liable for any amount exceeding the compensation actually paid by the carrier or insurer, except where liability cannot be excluded under mandatory consumer protection law.
Nothing in this Policy limits statutory consumer rights.
7. Governing Law
This Returns & Refund Policy is governed by Dutch law.
If you qualify as a Consumer under EU law, mandatory consumer protection provisions of your country of habitual residence may apply in addition to Dutch law.
